Terms and Conditions
These Terms and Conditions (the “Terms and Conditions”) apply to all Sellers, Buyers, as defined below, and any visitors accessing the Platza platform.
While certain terms may be specific to either Buyers or Sellers, the other party must acknowledge and approve them, even if they do not directly apply.
Welcome to Platza (“we”, “our”, “us”, “Platza”, the “Platform”, and/or the “Site”, ). We’re happy to do business with you (i.e. visitor, Seller, and/or Buyer “you”, “yourself”, “your”, “yours”), but first, please read our Terms and Conditions carefully along with all further linked information and documents, including the signed “Marketplace Agreement”, to understand our policies and procedures. These Terms and Conditions are formulated in compliance with the applicable laws.
While reviewing the Terms and Conditions, be aware of the services provided by Platza to the Sellers and the Buyers (the “Services”).
This document represents our Terms and Conditions, which govern your, access to, membership on and use of Platza, and Buyer’s purchasing (the “Buyer”), and Seller’s selling (the “Seller”) of products (the”Products”) through the Site.
Acceptance of Terms and Conditions
By accepting these Terms and Conditions (including the linked information herein), and by using the Site, you consent to follow and be bound by them. This document is effective upon acceptance. If you do not accept to follow these Terms and Conditions or you do not agree with all or any part of them, please do not access, register with, or use this Site, subsequently, the Marketplace Agreement entered by and between Platza and the Seller shall be automatically terminated at your own responsibility, without the need of any notice or any other judicial formality.
By accessing the Site, registering on the Site or purchasing or selling Products through the Site, you (1) acknowledge and agree to the following Terms and Conditions, without the need for a written signature, (2) you represent and warrant that you have the right, authority, and capacity to enter into these Terms and Conditions and to abide by all the requirements described in these Terms and Conditions.
Eligibility for Membership
All members on Platza should be able to form legally binding contracts. Therefore, by using the Site and accepting our Terms and Conditions, you acknowledge and confirm that you are at least 18 years of age before you became a member of the Site or you have legal parental or guardian consent, and you are not prohibited from entering into contracts. We reserve the right to limit or withdraw, immediately and without any notice or any judicial formality, access to the Site for any member should Platza believe that member to be under the age of 18 years or do not have legal parental or guardian consent, or is prohibited from entering into contracts. The Site is not available to persons whose membership has been suspended or withdrawn by Platza. If you are registering as a business/corporate entity, you acknowledge that you have the authority to bind that entity by these Terms and Conditions and that you and the business/corporate entity will comply with all applicable laws relating to online trading, and that the entity is duly registered and in good standing and have the authority to conduct the business it is currently involved in. No person or business entity may register as a member of the Site more than once.
Your Account and Registration Obligations
Establishing a Membership
When you register as a member on the Site, you are required to:
- [Applicable for Seller] sign the Marketplace Agreement with Platza. Failure to sigh such Marketplace Agreement, its suspension or its termination shall immediately terminate your Membership on the Site, without any liability, and without any notice or any other formality or any judicial formality.
The following applies to both Seller and Buyer:
• agree on these Terms and Conditions.
• Provide true, accurate, and complete contact information and identification details including but not limited to your legal name, full address, contact details, registered address, pick-up address, bank account details, trade names, pricing details of the Products, and/or any other details that may be requested by the Platform from time to time.
• Submit any form of authentication as required by Platza as part of the registration process.
• Avoid including(1) any of your contact details, such as your email addresses, telephone numbers, or any other personal details; and (2) the word “Platza” in your registration user ID.
• Avoid including the word “Platza” or any of its derivatives in your store name.
Use of Membership
Platza is not liable for any direct, indirect or consequential loss or loss of profits, goodwill or damage whatsoever resulting from the disclosure or misuse of your username and/or password. By becoming a member on the Site, you consent, covenant, warrant, and acknowledge that you will:
• Accept responsibility for all activities that occur under your account or password.
• Maintain the confidentiality of your account and password.• Restrict access to and use of your account.
• Notify Platza immediately of any unauthorized use of your account or any breach of security.
• Never use another member’s account at any time, without the express permission of the account holder.
• Never disclose your contact details including but not limited to phone numbers, addresses, or email addresses in commerce or listing processes, or anywhere on the Site including the feedback area, discussion forum or through any e-mail feature of the Site intended to bypass use of Platza.
• Never use another user’s data for any purpose other than fulfilling a relevant transaction resulting from selling item(s) on the Site.
• Reimburse and indemnify Platza for any improper, unauthorized, or illegal use of your account by you or by any person obtaining access to the Site through your designated username and password, regardless whether you authorized such access or not.
• Treat any other member’s information provided to you by Platza or any other user as strictly confidential.
• Regularly update the registration data to keep it true, accurate, up-to-date, and complete. If you provide any information that is false, inaccurate, not current or incomplete or if Platza believes or considers that such information is false, inaccurate, not current or incomplete, or not in accordance with these Terms and Conditions, Platza reserves the right to suspend, limit or withdraw your access to the Site and/or your membership of the Site, without any liability, any notice, or any other formality or judicial formality .
• Platza may, at its sole discretion and at any time, make any inquiries it considers necessary (whether directly or through a third party), and request that you provide it with further information or documentation, including without limitation to verify your identity and/or ownership of your financial instruments. You shall be cooperative in this regard. Without limiting the foregoing, if you are a business entity or registered on behalf of a business entity such information or documentation may include your trade license, other incorporation documents and/or documentation showing any person’s authority to act and sign on your behalf, and any other corporate documents requested by Platza. You agree to promptly provide any information and/or documentation to Platza upon such requests. You acknowledge and agree that if you do not, Platza, may, without liability, without any notice or any other formality or judicial formality: (1)limit, suspend or withdraw your access to the Site and/or your membership of the Site, (2)cancel unconfirmed/unverified accounts or accounts that have been inactive for a long time. Never engage in false or fraudulent activity in connection with the use of the Site. You acknowledge and consent that Platza may suspend, limit or withdraw your access to the Site and/or your membership of the Site, without liability, without any notice or any other formality or judicial formality, if you are found to have engaged in false or fraudulent activity in connection with the use of the Site.
• Never transfer your Site account (including feedback) and username to another party without our explicit consent.
• Never engage in the purchase or the selling of a product you are not legally entitled to purchase or to sell, for example in the purchase of alcohol & cigars (except for Sellers who are entitled to sell alcohol & Cigars and who shall refrain from selling it to Buyers below 18 years old). In such case, Platza reserves the right, at its sole discretion and without any liability from/any kind whatsoever, and without any notice or any other formality or judicial formality, to refuse service, terminate accounts, remove or edit content, or cancel orders.
• If the access to our Platform is against the laws of the place where you are accessing it, you shall not use our Platform and/or not use our Services, without prejudice to our rights whatsover. You are responsible for informing yourself of and abiding by the laws and regulations of your jurisdiction.
Listing and Selling Products
Listing Products for Sale
Without prejudice to Platza’s discretionary right to reject any Product, and without prejudice to the provisions of the Marketplace Agreement, as a registered member of the Site, you may list Product(s) for sale on the Site. By doing so, you acknowledge and represent that you are the sole and exclusive legal and beneficial owner of any and all Products of any description that you list for sale on the Site and you have the full right and authority to use such Products for trade. When listing Products, you may only include text descriptions, graphics and pictures that describe your Product for sale accurately. The listing description of the Product must not be misleading and must describe the actual current condition of the Product. If the Product description does not match the actual current condition of the Product, you agree to refund any amounts in relation to that Product that you may have received from the Buyer. All listed Products must be listed in an appropriate category on the Site. Soliciting business offline or outside of the Site, by indicating your contact details (e.g. contact phone number, address or e- mail) in the Product listing or elsewhere on the Site other than in your registration data is expressly prohibited and would constitute a breach of these Terms & Conditions. You agree not to list a single Product multiple times across various categories on the Site. You acknowledge and agree that Platza has the right to delete such multiple. Listings of the same Product. You will also acknowledge, covenant, warrant, and consent never to do the following under any circumstance:
• Post information or content or list items in an inappropriate section on the Site.
• Post information that is (as determined in our sole discretion) false, fraudulent, inaccurate, misleading, libelous, defamatory, slanderous, obscene, unethical, unlawfully threatening or would be considered as constituting harassment.
• Post comments, questions or answers that are not factual.
• Make any racist comments, use profanity, abuse another user, disrespect another’s culture or make any other derogatory or inappropriate comments.
• Post any content in a way that violates the intellectual property rights of Platza and/or third parties. Refrain from invading the privacy of others (including Platza and other visitors or members) by, inter alia, collecting data or post unauthorized information and spams.• Upload viruses, disseminate viruses, or any software or whatsoever or do anything that might impair the Site, or damage the property of another.
• Use the Services in an illegal, illicit, deceptive, dishonest, fraudulent, harmful, damaging, improper and/or unethical way.
• Post counterfeit or stolen items.
• Post information or items which infringe any third party’s intellectual property rights, other proprietary rights or right to privacy.
• Post obscene information or content, including, but not limited to, pornography or any representation which may (as determined at our sole discretion) be considered indecent.
• Post information or content which may (as determined at our sole discretion) constitute offensive or critical political content or content that is contrary to the public interest.
• Post any information or content or list items which may (as determined at our sole discretion) be considered culturally or religiously offensive in any way.
• Post information or content or list items which may (as determined at our sole discretion) threaten national security.
• Post information or content or list items which may (as determined at our sole discretion) constitute or be considered to promote gambling.
• Obstruct Platza from proceeding, in case the same Products are sold by multiple platforms or multiple sellers, to aggregate and showcase the best Products data to enhance the Buyer’s experience.
• Use “keyword spamming” in listing items for sale (i.e. when you place brand names or other inappropriate keywords in a title or description for the purpose of gaining attention or diverting members to a listing) By agreeing to these Terms and Conditions, you undertake that you will inform Platza of any postings, items or transactions which appear to be in violation of the aforementioned. .
• Refrain from providing details regarding your Products including the names and addresses of manufacturers or packers or suppliers, and any relevant details pertaining to the Products.
• Refrain from providing the relevant guarantees or warranties applicable to the Products you intend to sell on the Platform. The breach of any of the stipulations of this clause allows Platza to terminate immediately your membership, and the Marketplace Agreement on your full responsibility, without the need for any notice and without the need for any formality or any judicial formality.
Selling an Item
When a Buyer purchases a Product from a Seller, Seller consents to deliver such Products immediately, unless the Buyer fails to meet the posted terms. Seller acknowledge and consent never to conduct any of the following activities related to its commerce activities on or through the Site:
• Use contacts made by buying or selling on the Site to solicit (including by email or otherwise) sales on other products directly and/or from another website.
• Claim a Product was not sold when Platza has determined at its sole discretion that the Product was sold in accordance with these Terms & Conditions and the Site’s policies.
• Manipulate or attempt to manipulate the Site in any way including the prices of any Product or Services on the Site (either alone or in conjunction with other users).
• Circumvent or manipulate our fee structure, the billing process, or fees owed to Platza.
• Take any action that may undermine the Site’s feedback and ratings systems (including but not limited to the display, import or export of feedback information off the Site or use of such information for purposes unrelated to Platza).
• Use contact information provided to you during the course of a transaction on the Site to solicit additional sales offline or on another website.
• Collect information about users, including but not limited to email addresses and other contact information.
• Be late in obtaining all necessary consents and permissions from Buyers and users whose personal data is collected or processed.
• Disclose or publicize any personal information about users or otherwise access or use information about other users in a manner which (as determined in our sole discretion) may constitute a breach of privacy and/or applicable laws.
Prohibited Products for Sale
Sellersare, under no circumstance, to directly or indirectly offer, attempt to offer, trade in, attempt to trade in, or include descriptions or links to any of the following Products on or through the Site:
• Securities, including shares, bonds, debentures, or any other financial instruments or assets of any description as well as insurance products.
• Living or dead creatures and/or the whole or any part of any animal which has been kept or preserved by any means whether artificial or natural including but not limited to rugs, skins, specimens of animals, antlers, horns, hair, feathers, nails, teeth, musk, eggs, nests, other animal products of any description the sale and purchase of which is prevented or restricted in any manner by applicable laws.
• Weapons of any description.
• Drugs, psychotropic substances, narcotics, intoxicants of any description, medicines, palliative/curative substances.
• Any product which is likely to affect the religious sentiments of any person.
• Antiquities and art treasures as defined in applicable laws pertaining to antiquities and national treasures.
• Used cellular phone SIM Cards, except if the transaction is in accordance with the local operators’ rules pertaining to transfer of ownership of the same.
• Products that to your knowledge are defective, fake, damaged, false or misleading or that may through normal use harm another Site user’s interest or health.
• Fresh food or any other types of food.
• Non-transferable vouchers.
• Chemicals.
• Pharmaceutical and medical.• Any item or product or service you are not the sole, exclusive, undisputed owner.
• Any other Product prohibited by Platza.
Listings Policy for Perfumes
Sellers are, under no circumstance, to directly or indirectly offer, attempt to offer, trade in, attempt to trade in, or include descriptions or links to any of the following Products on or through the Site:
• Tester perfumes (which are usually bottles from which small quantities of perfume that can be taken for supply to consumers as free samples).
• Any perfume that comes from the original Manufacturer/ Brand as a tester (for testing, B2B sales or point of sale item) by the original designer of the perfume.
• Any perfume that has a different packaging from the standard consumer packaging (usually testers come in plain box).
• Any perfume that comes without the bottle’s “Cap” inside the package.
• Any perfume that has the word “tester” or “demonstration” written on the bottle.
• Any perfume which package is labeled as “Not for Sale”. Make sure your perfume listing follows the above. If it doesn’t, your listing may be removed
immediately without prior notice, without the need for any judicial formality, and on your full responsibility, and you may be subject to a range of other actions, including restrictions of your buying and selling items and suspension of your account.
Submitted Content
By submitting content to Platza you automatically consent to granting Platza and its affiliates an irrevocable, perpetual, worldwide, royalty-free, sub-licensable, transferable license to use, publish, display, modify, distribute, and syndicate your content worldwide. Platza does not claim any ownership of your content but we have your permission to use it or amend it for the purpose of operating and promoting the Site. You confirm and warrant that you have the requisite authority to grant the above license to Platza and its affiliates.
Use of the Site
By using the Site or any of its features and services, you acknowledge, represent, covenant, warrant, and consent to comply with all applicable domestic and international laws and regulations regarding and relating to your use of the Site. You also acknowledge, covenantconsent never to conduct any of the following activities:
• Harm our systems. You agree not to interfere with or try to disrupt the Site or the interests or property of the Site’s users by doing activities such as, but not limited to, distributing a virus or other harmful computer code, unsolicited or bulk electronic communications, chain letters, and pyramid schemes. You agree not to use the Services to engage in or create any gambling, sweepstakes or pyramid scheme.• Create liability for us or cause us to lose (in whole or in part) our services or the services of other suppliers or third parties.
• Take any action that imposes or may impose (as determined in our sole discretion) an unreasonable or disproportionately large load on our infrastructure.
• Interfere or attempt to interfere with the proper working of the Site or alter and/or impair the Site, its functionalities and/or its features.
• Attempt to take over another user’s account or carry out any hacking or phishing of the Site or user accounts and related features.
• Export or re-export any Site tools except in compliance with the export control laws of any relevant jurisdictions.
• Copy, modify, or distribute any content from the Site or otherwise infringe the Site’s and/or third parties’ copyright material and/or trademarks in any way.
• Violate any laws, rules, regulations, guidelines, third-party rights, or our policies.
• Abuse Platza’s policies or Terms and Conditions posted on the Site.
Electronic Communications
When you use Platza, you consent to receive communications from us electronically, including, but not limited to, emails, text messages, and messages on and through the Site. You can retain copies of these communications for your records only and you agree that all legal documents and communication that we provide to you electronically satisfy any legal requirement that such communications be in writing. Platza will ask for your approval during the registration process to send you promotional emails that let you know about new changes, features, or promotions on the Site. If at any time you decide not to receive such promotional emails, you can opt out of receiving such emails by clicking on the link at the bottom of any promotional email sent by us.
Fees and Services
Membership on the Site is free. Platza. Platza charges transaction fees to all Sellers when their Product is successfully sold on the Site, as per the terms set out in the Marketplace Agreement and the Yearly Commission Agreement (if applicable), listing fees for classifieds, and special listing fees to Sellers who use the special listing feature for listing their items. All Sellers' dues and payables (processing fees, commissions, return fees, others) to Platza will be deducted from the amounts collected on behalf of the Sellers after a successful sale transaction. Platza reserves the right to amend the fees at any time with immediate effect by posting the changes on the Site. New applicable fees enter immediately into effect even if the Marketplace Agreement or the Yearly Commission Agreement are not amended yet. We strongly recommend you to review the fees that you will be charged before you list any Product for sale on the Site. Platza, with mutual agreement with the Seller, may decide to temporarily modify the fees for promotional purposes, such as free shipping days or launching new services, and such temporary modifications are effective immediately when we post them on the Site. Platza offers a loyalty rewards program for registered Buyers, aimed at enhancing their shopping experience through exclusive benefits and incentives.

Platza offers a loyalty rewards program for registered Buyers, aimed at enhancing their shopping experience through exclusive benefits and incentives
1. Earning Points
− Full-priced items: Buyers earn 1 point for every $1 spent.
− Discounted items: Buyers earn 0.5 points for every $1 spent.
− Points are accumulated based on the final amount paid after discounts and promotions.
2. Loyalty Tiers: The loyalty program is structured across three tiers based on annual spending and points collected:
a. Entry Level
− Annual spending: $500
− 1$ = 1 point (for all items)
− Early access to sales and promotions
− Birthday bonus: 50 extra points (with purchase)
− Upgrade threshold: 500 points
b. Intermediate Level (Silver)
− Annual spending: $5,000
− 1$ = 1 point (on full-priced items)
− Early access to sales and promotions
− Birthday bonus: double points (on purchase)
− 50$ gift card upon collecting 2,000 points within one year
− Free shipping on orders above $500
− Upgrade threshold: 5,000 points
c. Advanced Level (Platinum)
− Annual spending: $15,000
− 1$ = 2 points (on full-priced items)
− Free shipping on all orders
− Ongoing 5–10% promo codes on selected categories
− Complimentary gifts throughout the year
− End-of-year VIP gifts
3. Points Expiry: Loyalty points expire annually, based on the anniversary of the user’s registration or loyalty tier enrollment date.
Payment by Buyers
Platza offers Buyers the option to pay for Products on the Site either online or through Cash On Delivery (COD) or any other payment methods made available on the Site at the time of posting these Terms and Conditions. Platza merely facilitates the payments by Buyers but Platza is not involved in the process of buying and selling Products on the Site. All sales and purchases on the Site continue to be bipartite contracts between the Buyer and the Seller of Product(s) and Platza is not responsible for any non-performance, breach, or any other claim relating to or arising out of any contract entered into between any Buyers and Sellers, nor does Platza have any fiduciary duty to any user.
All commercial and contractual terms, including but not limited to price, shipping cost, payment methods and terms, delivery dates, periods, modes, product warranties, and after-sale services, are exclusively offered by the Seller to the Buyers and agreed upon between the Seller and the Buyers. PLATZA and/or its Platform have no control, influence, or involvement in these terms. Therefore, the Seller shall hold PLATZA and its Platform harmless and indemnify them against any claims, requests, judicial or extra-judicial actions from the Buyers or any other parties in this regard.
Intellectual Property
All content posted on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, content, and software, is the property of Platza and/or third parties and is protected by copyright, trademarks, patents, or other intellectual property rights and laws. The compilation of the content on the Site is the exclusive property and copyright of Platza and/or third parties and is protected by copyright, trademarks, patents, or other intellectual property rights and laws.
Trademarks
The name Platza and the other Platza phrases, logos, and related designs that we use in connection with our Services are either registered or unregistered trademarks of Platza and/or third parties, and are protected by international trademark and other intellectual property rights and laws. Platza’s trademarks may not be used in connection with any product or service that is not owned by Platza or in any manner that may harm Platza. All other trademarks not owned by Platza that appear on the Site are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Platza.
Buyer Protection
Users who shop at Platza receive full or partial refunds if the Product is not as described by the Seller or if they don’t receive their Product. This guarantee is offered by Platza to ensure Buyers that their purchase is protected against fraud by any Seller on the Site and/or to protect them from Sellers who engage in a fault, discrepancy, breach of obligations, misconduct, and/or negligence. If a Buyer has purchased a Product through Platza and never received it or received a product worth significantly less in value compared to what was described by the Seller, the Buyer will be reimbursed by Platza the value of the item only, such reimbursement being solely borne by the Seller. To be eligible for Buyer protection, the Buyer needs to file a complaint before Platza within seven business days of the initial date of delivery if the item hasn’t been received, or within seven business days from the effective receiving date of the relevant Product. Platza will investigate the matter and if it has been determined (at its sole discretion) that the Seller has intentionally defrauded the Buyer and/or the Seller has engaged in a fault, discrepancy breach of obligations, misconduct, and/or negligence in relation to the Product for which Platza has reimbursed the Buyer, Platza may limit, suspend or withdraw the Seller’s access to the Site and/or the Seller’s membership and Platza may charge the Seller for Platza’s costs in reimbursing the Buyer including without limitation, any handling and shipping costs. Platza reserves the right to take such further steps as it considers necessary, including, but not limited to, legal action.
Shipping Fees for Returned Products
The following section summarizes Platza’s policy for charging shipping fees for returned Products:
- The Seller shall abide by Platza's Return and Refund Policy. Automatic and prompt deductions from the Seller's account may occur for returns/refunds resulting from the Seller’s fault, discrepancy breach of obligations, misconduct, and/or negligence.
- In cases where returns are due to Seller’s default or discrepancy, the Seller bears all costs associated with return, refund, and initial delivery and/or all costs or fees associated therewith, including without limitation delivery shipment fees, return shipment fees, handling fees.
- Following Platza’s written approval, Platza and the Seller grant Buyers a 3-day return window. Return shipping costs will be shared equally between Platza and the Seller if the Buyer initiates the return within the specified timeframe and the Products meet return conditions. Any other fee or cost shall be solely borne by the Seller.
- Platza reserves the right to reject returns if Products show signs of use.
- All items are eligible for return as per terms outlined in the Return and Refund Policy unless otherwise specified during the purchase process.
- If a Buyer rejects a cash-on-delivery shipment, costs for both outbound and return shipping will be shared equally between Platza and the Seller.
Return Policy for Gifts
In case the Product received was a gift from another Platza user, the gift receiver can request the return of such gift within 3 business days of receiving it by contacting Platza on Platza’s contact details mentioned on the delivery receipt. If the return is accepted based on the return conditions mentioned below, the amount will be credited to the Platza account of the gift receiver. If the gift receiver doesn’t have a Platza account, the gift receiver will need to create one. The amount cannot be claimed in cash nor credited to a card. Delivery fees will be deducted from the gift value upon return.
Return Policy for Card Payments
In the event the Buyer has settled by card the price of the purchased Product(s) and wish to issue a return order within 3 business days of receiving the Product(s), the price of such returned Product(s) shall be returned to your bank account provided that the request claim is approved. The Buyer will cover the delivery fee and the returning shipping fees. However, it is noted that the amount may take time to reflect in your card statement, depending on your card provider.
Return Policy for Cash Payments
In the event you have settled in cash the price of the purchased Product(s) and wish to issue a return order within 3 business days of receiving the item(s), the price of such returned Product(s) excluding the delivery fees shall be credited to your Platza account. You shall have a period of one year starting the return collection date during which you can use the amount to execute other purchase(s) on the Site.
Return Policy for Undelivered Products
In the event Buyer’s order has not yet been delivered within the mentioned timeframe and Buyer wish to issue a return order, a return will be granted following a request that must be submitted by the Buyer to the support team. the Buyer will receive a full refund along with any shipping fees applied and will not be penalized. Refund policy will be implemented depending on the policy for the payment method applied.
Return Conditions
• Return requests should be made within 3 business days from receiving the Product.
• The Product should be in the same condition the Buyer received it. Any used or damaged Product can no longer be returned.
• If the Product is innerwear, lingerie, socks, stockings, tights, software, music albums, books, swimwear, beauty products, or fragrances, then the Product is not eligible for return.
• If the defective Product is part of a bundle package, the bundle Product can be returned.
• Platza will not process the return request if such request is not submitted Platza within the deadline stated in its Return Policy herein.
• Any Product purchased during a promotion or sale is not eligible for return..
User Information and Privacy
When Buyers, Sellers and visitors use the Site, they consent to their personal information being collected, stored, and used as per Platza’s Privacy Policy. If they do not agree to their information being used in the way described in Platza’s Privacy Policy, then they should not use the Site.
User Representations
Sellers, Buyers and visitors represent and warrant that:
• they are legally capable of entering into binding contracts.
• they will only use the Site for lawful purposes and in accordance with these Terms and Conditions.
• they will not use the Site for any illegal or unauthorized purpose.
• their use of the Site will not violate any applicable law or regulation.
• they will not impersonate any person or entity, falsely state or otherwise misrepresent their affiliation with a person or entity, or manipulate identifiers to disguise the origin of any content transmitted through the Site.
• they will not use the Site to defame, abuse, harass, threaten or otherwise violate the legal rights of others.
• they will notify Platza immediately if their device is lost or stolen or if someone is using their account without their consent or if their account has been hacked. Meanwhile, they will remain solely responsible for the use of the Services on their device.
• they are solely responsible for the content transmitted through the Site. In case of failure to the abovementioned , Platza reserves the right, without any liability from any kind whatsoever, and without any notice or any other formality or judicial formality to withdraw, suspend or terminate Buyers, Sellers and visitors’ use of the Site, on the latter’s responsibility.
Disclaimer of Warranties
All information, content, materials, products, and services included on or otherwise made available to you through the Site are provided by Platza on an “as is” and “as available” basis, unless otherwise stated in writing. Platza makes no representations, endorsements, or warranties of any kind, express or implied, regarding the accuracy, reliability, completeness, or operation of the Site, or the information, content, materials, products, and services made available through the Site. Platza will make reasonable efforts to provide quality services but does not guarantee that these services will be uninterrupted, continuous, error-free, timely delivered, or safe. Any claim, asserting that the Services’ features are missing, not as expected by you, or do not match those offered by similar services or competitors is rejected. Platza disclaims all representations and warranties, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, and the accuracy of information from third parties and resources. You expressly agree that your use of the Site and any downloaded content is at your own risk, and that you are solely responsible for any damage to your device or data loss that may result. Additionally, Platza has no obligation to offer support for the Site.
No waiver
The failure of Platza to enforce any provision of these Terms and Conditions does not constitute a waiver of that provision. The omission of Platza to act regarding any breach of these Terms and Conditions does not constitute a waiver of the right of Platza to act regarding subsequent similar breaches.

Platza is committed to preserving and protecting Buyers and Sellers privacy. When Platza believes in good faith that our disclosure of Buyers and/or Sellers PersonalData is necessary to prevent physical harm or financial loss.
To report suspected illegal activity.
To investigate a possible violation of these Terms and Conditions.
In the event of a sale, and/or any form of transfer of Platza, your personal data may be disclosed to any potential purchaser for the purposes of the continued provision of the Site or otherwise in relation to any such sale and/or any form of transfer.
Your Use of Personal Data
Registered users on the Site may need to share personal or financial information with each other to complete transactions on the Site. Platza’s Privacy Policy does not cover release of any personal information by a Site member to another Site member. Platza cannot guarantee the privacy of your Personal Data when a Site member share personal information with other Site members. Therefore,
Buyers and/or Sellers should always seek to know the privacy policies of other Site members prior to sharing their information with those other Site members.
As a user of the Site, Buyers and/or Sellers should respect, at all times, the privacy of other Site members. By using the Site, Buyers and/or Sellers agree to use any personal information received from another Site member in relation to a transaction on the Site solely for that transaction and not for any other purposes except with the express consent of the other Site member. Buyers and/or Sellers also agree to use personal information received from another Site member in accordance with the law at all times.
Accessing and Editing Your Information
Platza Registered users can access and change their personal information at any time by logging into the My Account section of the Site.
Please note that Platza shall retain personal information during and following the end of use of the Site as required to comply with the law, for technical troubleshooting requirements, to prevent fraud, to assist in any legal investigations, and to take any other actions otherwise permitted by law.
Third-Party Websites
The Site may contain links to other websites, but Platza is not responsible for the privacy practices of such other websites. For these websites, Platza strongly recommends that Buyers, Sellers and/or visitors read their privacy policies so they can understand the way in which their personal information will be processed by these websites. Platza’s Privacy Policy applies solely to Buyers, Sellers and/or visitors’ Personal Data that Platza collects through Buyers and/or Sellers’ use of the Site.
Cookies
The Site uses cookies to help Platza to recognizes users, learn about their interests, improve their experience using the Site, increase security, measure the effectiveness of the Site, and identify popular sections on the Site. The cookies Platza uses do not reveal any personal information about users. Users can control cookies through their browser settings and other tools, although doing so may interfere with their use of the Site.
No Spam or Spoof Emails
Platza does not tolerate spam. To report Site-related spam or spoof emails, users shall forward the email to info@platza.co . Users may not use the Site to send spam or otherwise send content that would violate our Terms and Conditions. Platza automatically scans and may manually filter messages to check for spam, viruses, phishing attacks, and other malicious or illegal content.
Storage and Encryption of Information
Platza holds users Personal Data on servers located in Lebanon. Platza takes every precaution and encrypt all users Personal Data to safeguard their personal information from unauthorized access, use, or disclosure. By registering and creating an account on the Site, users consent to the transfer of their Personal Data to, and its storage on, our servers located in Lebanon.
Termination for Breach
In connection with Buyers, Sellers and/or visitors use of the Site, you will not breach any of these Terms & Conditions. If you do, Platza may immediately and without liability and without a notice and any other formality and/or judicial formality, limit your activity, terminate your membership on the Site indefinitely or temporarily, end your listings, and/or warn other users of your actions, as well as terminate the Marketplace Agreement and the Yearly Commission Agreement (if applicable). All rights, obligations, including payment obligations, and liabilities incurred before termination remain in effect.
Platza may at any time and at its sole discretion reinstate suspended users. A user that has been indefinitely suspended or had their membership withdrawn may not register or attempt to register with Platza or use the Site in any manner whatsoever until such time that such user is reinstated by Platza. Notwithstanding the foregoing, if users breach any of these Terms & Conditions, Platza reserves the right to recover any amounts due and owing by users to Platza or any losses and damages caused by users to Platza and to take such steps, including legal action and/or the initiation of criminal proceedings against users, as Platza at its sole discretion deems necessary.
Limitation of Liability
In no event will Platza or its representatives (including without limitation, its affiliates, subcontractors, assignees, employees, agents, consultants, directors, shareholders, managers, officers) be liable for any direct, indirect consequential, incidental, special, exemplary, punitive or enhanced damages (indirect damages), lost profits, revenues, data or use or diminution in value, investment, revenue, return, reputation, contract, production, opportunity, goodwill, data business, savings, other intangible losses or goodwill, arising out of or relating to or in connection with Buyers and Sellers use of the Site, these Terms and Conditions, any breach of these Terms and Conditions, and/or arising from the use or inability to use the Services and/or access to the Site and/or application, regardless of whether such damages were foreseeable.
In no event will Platza or its representatives’ total cumulative liability for claims of any kind whether based on contract, tort, negligence, or otherwise, for any loss or damage exceed USD/1,000/ (One Thousand US Dollars).
Indemnity
Each Buyer, Seller or visitor agree to defend, indemnify, and hold harmless Platza, its affiliates, officers, agents, representatives, employees, stakeholders (including owners, employers, investors, users, partners) from and against any and all claims, demands, damages, costs, actions, losses, liabilities, and expenses, including reasonable attorneys' fees and legal expenses, made by any third party due to or arising out of or in connection with the Buyer, the Seller or visitor’s use of the Site, Buyer, Seller, or visitor breach of these Terms and Conditions, any representation or warranty, or violation of any law or the rights of a third party.
Force Majeure
Platza shall not be held liable for any failure and/ or breach and/or delay in the execution of its obligations under this Agreement if failure and/ or breach and/or delay are due to causes beyond its reasonable control, including but not limited to mechanical, electronic, or communication failures and/or breakdowns, degradation, hacker attacks, denial of service attacks, virus or other malicious software attacks or infections or power failures. If the event continues for more than 30days, this Agreement will be automatically terminated without the need of any notice or any judicial formality. All rights, obligations, including payment obligations, and liabilities incurred before termination remain in effect.
Providing Feedback
Users on the Site can provide feedback on each other’s conduct after a transaction has closed. Users feedback will be displayed along with theiruser ID on the Site. They cannot withdraw the feedback once they have posted it on the Site. Platza will not be liable for the feedback that they post on the Site. If they continuously receive negative feedback ratings, Platza reserves the right to suspend, limit, or withdraw their access to the Site and/or your membership of the Site without the need of any notice, formality and any other judicial formality. Users acknowledge and agree that they shall not market or export their Platza feedback rating to any third party other than on the Site.
Independent Contractor
Nothing herein shall be deemed to constitute a partnership, joint-venture, a participation in an unincorporated business or agency in law nor an employment contract between the parties between Buyers, Sellers and/or visitor on one hand and Platza on the other hand, and Buyers, Sellers and/or visitor shall have no authority to bind Platza in any manner. Platza shall not be rendered, liable, as principal, surety, guarantor, agent or otherwise for any of the debts, obligations or liabilities of any kind and nature of Buyers, Sellers and/or visitors.
Transfer of Rights and Obligations
Sellers, Buyers and/or visitors hereby grant Platza the right to, and irrevocably acknowledge and agree that Platza may at any time, transfer all or any part of its rights, benefits, obligations, or liabilities (whether express or assumed) under these Terms & Conditions to any of its affiliates without requiring Sellers, Buyers and/or visitors further specific agreement. Platza agrees to use all reasonable endeavors to provide notice to users of any transfer by way of a posting on the Site. Users may not at any time, without the prior written consent of Platza, transfer all or any part of your rights, benefits, obligations, or liabilities (whether express or assumed) under these Terms & Conditions.
Warranty Information
The warranty is valid only in the presence of the serial number of the purchased item. If the serial number has been removed or changed after purchasing the item through the Site, Platza reserves the right to refuse warranty. Warranty is provided by replacing defective spare parts in case of a factory defect and not necessarily by replacing the device or refunding its value. Platza may, in its sole discretion, offer a replacement or a refund. The warranty is not applicable to cases other than defects in material, design, and workmanship. Misuse of the device or not following the proper usage instructions as provided in the device manual or the instructions given on webpages or digital agreements upon the device’s activation will void the warranty. Breakage or physical damage as well as exposing the device to external elements such as liquids, humidity, or extreme temperatures will void the warranty. Unauthorized repair attempts that result in damaging the device will void the warranty.
Severability
If any provision or part of provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severed from these Terms and Conditions and shall not affect the validity and enforceability of the remaining provisions of these Terms and Conditions.
Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Lebanon. Any disputes arising out of or in connection with or related to these Terms and Conditions, their validity, their interpretation, their implementation and their termination shall be subject to the exclusive jurisdiction of the courts of Lebanon.
Amendments to These Terms & Conditions
Platza reserves the right to make changes to the Site, its features, its functionality, policies, and these Terms & Conditions at any time without your prior consent and with immediate effect by posting a notice of the amendment on the Site. If any of these Terms & Conditions shall be deemed invalid, void, or for any reason unenforceable, they shall be deemed severable and shall not affect the validity and enforceability of any of the remaining Terms & Conditions. Platza will notify you of any amendment to these Terms and Conditions that materially increases your obligations or decreases your rights in accordance with the terms of these Terms & Conditions.
